Understanding Federal EEO Hearings: Insights   from EEOC Administrative Judges

Through outreach and education, the Equal Employment Opportunity Commission (EEOC), provides guidance to federal agencies on all aspects of Equal Employment Opportunity (EEO) compliance expectations. 

This workshop will not only provide an overview of the federal sector administrative hearing process, it will also provide federal agency leaders with viable EEO information, tips and best practices to stay on the EEO compliance track.

Our esteemed team of EEOC Administrative Judges, will discuss topics such as the investigative process, the Rehabilitation Act, The Pregnancy Workers Fairness Act. You will also learn about recent employment law cases and be imparted with tools to help you effectively navigate and avoid the missteps of workplace discrimination. 

This workshop is designed specifically for federal sector leaders, including federal sector HR professionals, managers, supervisors, attorneys, and anyone else desiring to know the current state of federal workplace discrimination laws.

10:00 a.m. Opening remarks, Linda Sales-Long, Deputy Director, EEOC Birmingham District Office

10:05 a.m.   Understanding Workplace Retaliation: A Hearings Perspective  Kurt Fischer, Administrative Judge, EEOC Birmingham District Office, Hearings Unit. Learn about types of retaliation issues typically observed in federal sector EEO hearings, common misconceptions, and tips on how to address or avoid retaliatory behavior from an Administrative Judge’s viewpoint.

10:35 a.m. Reasonable Accommodation in Hearings: Lessons from the Field Russ Parker, Administrative Judge, EEOC Birmingham District Office, Hearings Unit. This session will over common reasonable accommodation issues seen during hearings. The administrative Judge will provide tips regarding the importance of documentation, including real-world examples of how these issues are handled during the Administrative Hearings phase.

11:05 a.m. Pregnant Workers Farness Act (PWFA) Issues Observed in Hearings: What Stakeholders Need to Know                                           Geraldine Daniels, Administrative Judge, EEOC Birmingham District Office, Hearings Unit. This session explores key points regarding PWFA claims, legal protections, and how these issues are beginning to appear in hearings. The Administrative Judge will also share information regarding available resources covering the PWFA.

11:35 a.m. Recent Office of Federal Operations (OFO) Case Trends          Mason Barrett, Supervisory Administrative Judge, EEOC Birmingham District Office, Hearings Unit. This session will provide a high-level overview of some of the notable trends regarding the Office of Federal Operations decisions as observed by the Administrative Judge. (Note: This session is based on the Birmingham Administrative Judge's experiences and observations, not an official Office of Federal Operations case summary).
